Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes which uses of Webforged's services are permitted and which are prohibited. It forms part of the agreement between you and Webforged and applies in addition to our general terms and conditions.

Webforged is based in the Netherlands (VAT NL003249865B86) and provides web development, online stores, maintenance and hosting services. By using our services you agree to this policy.

1. Scope and who this policy applies to

This policy applies to all services provided by Webforged, including the hosting of websites, online stores and applications, their management and maintenance, email and domain services, and all related infrastructure. It applies to all customers, end users, administrators and any third parties who use the services on behalf of or through a customer.

  • Hosting of websites, online stores and (web) applications on our infrastructure.
  • Management, maintenance, backups and security of hosted environments.
  • Email, domain and related services that we provide.
  • All users who gain access via a customer's account, API key or admin environment.

2. Permitted use

You may use the services for lawful business and personal purposes that comply with the agreement, this policy and applicable law. Permitted use includes, among other things:

  • Hosting and publishing legitimate websites, online stores and applications.
  • Storing and processing data for which you hold the necessary rights and consents.
  • Normal and reasonable use of the allocated compute, storage and bandwidth capacity.
  • Sending transactional or permitted email in compliance with applicable anti-spam rules.

3. Prohibited, restricted and high-risk activities

You may not use the services for activities that are unlawful, harmful, fraudulent or infringing, or that endanger the operation, reputation or security of Webforged, other customers or third parties. The following, among other things, is prohibited:

  • Content that breaches the law, including child sexual abuse material, incitement to hatred or violence, terrorism or threats.
  • Infringement of intellectual property rights or distributing copyrighted material without authorisation.
  • Distribution of malware, viruses, ransomware or other malicious code.
  • Phishing, scams, identity fraud, pyramid schemes or any other fraudulent scheme.
  • Unsolicited bulk email (spam) or violating anti-spam legislation.
  • Hacking, unauthorised access, port scanning, denial-of-service attacks or circumventing security.
  • Cryptomining, abuse of resources or activities that place a disproportionate load on the infrastructure.
  • High-risk or regulated activities (such as gambling, weapons, controlled substances or financial services) without the required licences and Webforged's prior written consent.

4. Compliance with laws, regulations and sanctions

You are responsible for complying with all applicable laws and regulations in your use of the services, including privacy and data protection law (such as the GDPR), consumer law and e-commerce rules. You may not use the services in breach of applicable export, trade or sanctions law, nor by or for the benefit of persons, entities or countries that are subject to sanctions imposed by the EU, the Netherlands or other competent authorities.

5. Preventing abuse, fraud and harmful content

You must take reasonable measures to prevent abuse of your environment. This includes keeping software up to date, using strong credentials and reporting security incidents promptly. Webforged may take technical and organisational measures to detect and limit abuse, fraud and harmful content.

  • Keep applications, plugins and dependencies up to date and secure.
  • Use strong, unique passwords and protect API keys and credentials.
  • Report suspected abuse, data breaches or security incidents to Webforged immediately.

6. Responsibility for third parties and sub-users

If you give others — such as employees, customers, end users or sub-users — access to the services or host content on their behalf, you are responsible for their use and for their compliance with this policy. You must ensure they are aware of and comply with the relevant rules. Violations by third parties or sub-users are treated as violations by you.

7. Monitoring, enforcement, suspension and termination

Webforged is not obliged to actively monitor content or traffic, but reserves the right to investigate use and to act in the event of a (suspected) violation of this policy or a legal obligation. Depending on the severity, Webforged may take measures ranging from a warning to removing content, restricting or suspending the services, or terminating the agreement — where possible after notice, but without prior notice where this is necessary to prevent harm, legal liability or an acute security risk.

  • Investigation upon a suspected violation or complaint.
  • Removing or disabling access to infringing or harmful content.
  • Restricting or suspending (part of) the services.
  • Terminating the agreement in the event of serious or repeated violations.
  • Disclosing information to competent authorities where required by law.

8. Changes and contact
